This Privacy Policy applies to Kinaxis Inc., and its affiliated entities throughout the world (collectively referred to as “Kinaxis”, “we”, or “us”).
Kinaxis is committed to protecting the Personal Information entrusted to us. This Privacy Policy outlines what Personal Information we collect, how we use and share it, and the safeguards we have in place to protect it. It also explains the choices available to you regarding the collection, correction, and deletion of your information. We will not use or share your Personal Information with anyone except as described in this Privacy Policy.

Compliance with data privacy laws
The processing of Personal Information (as defined below) is subject to regional and national data privacy laws. Kinaxis adheres to applicable data privacy laws in its handling of Personal Information.
What is personal information?
“Personal Information” means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
Personal Information may include the following: name, address, date of birth, gender, and contact data (e.g., e-mail address, telephone number).
Scope of Privacy Policy
This Privacy Policy applies to Personal Information collected by Kinaxis or its service providers from or about:
i) Visitors to, or users of, its websites;
ii) Prospective and current customers using Kinaxis services;
iii) Service providers and business partners;
iv) Other third parties that it interacts with.
This Privacy Policy does not apply to any Personal Information processed by Kinaxis on behalf of its customers as part of the provision of its software-as-a-service offerings. Such processing is covered by the terms and conditions with the Kinaxis Data Processing Agreement located in the Kinaxis Trust Centre [link].
This Privacy Policy does not apply to Personal Information from or about prospective, current, or former employees of Kinaxis. The Kinaxis Recruitment Privacy Policy located in the Kinaxis Trust Centre [link] covers the processing of Personal Information from or about prospective employees as part of the recruitment process. Separately, the Kinaxis Employee Privacy Policy covers the processing of Personal Information from or about current or former employees. Personal information collected by Kinaxis
1. Information provided to Kinaxis by its customers
Kinaxis collects and processes Personal Information about its prospective, current, and former customers, as necessary to promote and develop our business and manage our business relationships. This Personal Information may include business contact details (such as name, e-mail, phone number, address), job details (such as job role, employer, work location), service usage data, and information on interactions with us (such as the channel used to reach out to Kinaxis and the types of information requested and/or consumed).
2. Information collected automatically by Kinaxis
Kinaxis may collect Technical Information about you when you visit our website, which your web browser automatically sends whenever you visit a website on the Internet. “Technical Information” is information that does not, by itself, identify a specific individual, but which could be used to indirectly identify you. Our servers automatically record this information, which may include your Internet Protocol ("IP") address, browser type, browser language, and the date and time of your request. Gathering your information helps us ensure our websites and other services work correctly and support our customer analytic efforts.
In order to obtain access to portions of the Kinaxis website, Kinaxis may ask you to complete a registration form that identifies Personal Information or solicits comments. Upon registration, email and other Personal Information are collected to allow the interface with the user. This is done with the express consent of the user, prompted by a request to agree.
Email communication: We use pixel tags and cookies in our marketing emails so that we can track your interaction with those messages, such as when you open the email or click a URL link that’s embedded within them. When recipients click on one of those URLs, they pass through a separate web server before arriving at the destination page on a company's website. We use tools like pixel tags and cookies so that we can determine interest in particular topics and measure and improve the effectiveness of our communications.
Cookies and similar technologies: Kinaxis uses cookies and similar technologies to operate and improve our websites, support functionality, personalize your experience, and help us better understand user behaviour. When you visit our websites, our servers send a cookie to your computer or mobile device to recognize your browser and tailor content or advertisements. Cookies are used solely to recognize your web browser, and the information they collect does not personally identify you. We may also use web beacons to gather information about your visit or email interactions, primarily to deliver more relevant content and improve our services. 3. Information collected from social media applications
Our website includes social media features. These features may collect your IP address and which page you are visiting on our site and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our website. Your interactions with these features are governed by the privacy policy of the organization providing them. For example, if you create or log into your account through a third-party social networking site, we may have access to certain information from that site, such as your name, account information, and friends, in accordance with the authorization procedures determined by such third-party social networking site.
4. Information collected from Kinaxis’ website chatbot
Our website also includes the optional use of a chatbot. Use of the chatbot does not require your Personal Information; however, you may choose to input your Personal Information into the chatbot. Kinaxis will collect and process this Personal Information in accordance with this Privacy Policy. A transcript of your interaction with the chatbot is automatically created and may be referenced by Kinaxis if you request further information from Kinaxis. The transcript may also be accessed by Kinaxis and its chatbot service provider for support purposes, if necessary.
5. Information collected from other sources
Kinaxis may also collect information about you from other sources to help us correct or supplement our records, improve the quality or personalization of our services to you, and prevent or detect fraud. In order to provide services to you and improve Kinaxis’ website, we may engage the services of third-party vendors. In the process of supplying services to Kinaxis, these third-party vendors may need to collect Personal Information about you.
Permitted use of personal information
Kinaxis uses your Personal Information to provide you with products and services, such as to fulfill your requests for products or to help us personalize our offerings to you. We also use your Personal Information to support our business functions, such as fraud prevention, marketing, and legal functions.

- Customer outreach: To develop the Kinaxis business by providing relevant and timely direct communications;
- Personalize offerings: To help us personalize our service offerings, websites, mobile services, and advertising;
- Social media management: To manage and analyze interactions, engagements, and campaigns through our social media accounts;
- Protection: To protect the security and integrity of our websites, mobile services, and our business;
- Website management: To ensure the proper operation of our website;
- Legal: To comply with legal and/or regulatory requirements;
- Responding to customer: To respond to reviews, comments, or other feedback you provide us;
- Internal training: With your consent, we may use information from interactions with you to provide training to our teams and improve the quality of your interactions with Kinaxis;
- Promotional messaging or advertising: With your consent, Kinaxis uses your contact information to recommend products and services that might be of interest to you, to send you marketing and advertising messages such as newsletters, announcements, or special offers or to notify you about our upcoming events. You may unsubscribe from such emails at any time.
Disclosure of personal information
- Third parties: Kinaxis will not rent or sell your Personal Information to others but may disclose Personal Information with third party vendors and service providers that work with Kinaxis. We will only share Personal Information with these vendors and service providers to help us provide a product or service to you at your request and in accordance with our respective agreements. We will ensure appropriate contractual clauses are in place to ensure compliance with data protection legislation.
- Business purposes: In a prospective business transaction, Kinaxis may disclose Personal Information where Kinaxis has entered into an agreement that restricts the use and disclosure of that data solely for purposes related to the transaction, protects the data by security safeguards appropriate to the sensitivity of the information, and if the transaction does not proceed, the data is returned to Kinaxis or destroyed within a reasonable time.
- Legal and safety reasons: Kinaxis may be required to disclose Personal Information to law enforcement agencies, government agencies, or legal entities. We may disclose information by law, litigation, or as a matter of national security to comply with a valid legal process including subpoenas, court orders, or search warrants, and as otherwise authorized by law. Kinaxis may also disclose Personal Information in emergencies affecting life, health, or security. Disclosure may occur without consent if necessary to prevent fraud, investigate a breach, or identify an injured, ill, or deceased individual.
- Through links to third party websites, services, and applications: Kinaxis is not responsible for any Personal Information collected through these means. Information collected is governed by the privacy policy of the third party.
Security measures taken to protect personal information by Kinaxis
Security of all information is of the utmost importance for Kinaxis. Kinaxis uses technical safeguards such as encryption, physical safeguards such as secure areas, and organizational measures such as access controls and due diligence to protect the security of your Personal Information from unauthorized disclosure.
We also make every attempt to ensure that only necessary people and third parties have access to Personal Information. We require that our third-party service providers and channel partners agree to keep all confidential information we share with them and to use the information only to fulfil their obligations in the agreements we have in place with them. These third-party service providers and channel partners are expected to maintain privacy and security protections consistent with Kinaxis’ privacy and information security policies.
Data retention and storage

Kinaxis retains your information for business purposes, for as long as your account is active, and/or as long as it is reasonably necessary to provide you with our products and services. Kinaxis will also retain your information as reasonably necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We may also retain cached or archived copies of your information for a reasonable period of time. At any point, you can withdraw your consent, and we will immediately stop processing your data.
International transfer of personal information
Kinaxis may share customer information within our family of companies or with third parties, such as our service providers, for a variety of purposes. To facilitate our global operations, Kinaxis may transfer Personal Information from your home country to other locations around the world. To protect your Personal Information, we will transfer data in accordance with applicable data privacy laws. If Personal Information is transferred to countries that do not provide an adequate level of protection, Kinaxis will implement appropriate safeguards such as Standard Contractual Clauses (SCCs) and other legally recognized safeguards.

- Right to inquire: In compliance with the GDPR, Kinaxis commits to resolve complaints about your privacy and our collection/use of your Personal Information.

- Right to consent: You can revoke consent at any point, and Kinaxis will stop processing your Personal Information.
- Right to erasure: You may request that Kinaxis erase your Personal Information when it is no longer necessary for the original purpose or upon withdrawal of consent.
- Right to rectification: You can request correction of inaccurate or incomplete data, and Kinaxis will notify third parties of changes.
- Right to restrict processing: You can request Kinaxis stops using or processing your data.
- Right to object: You may object to processing for profiling, direct marketing, scientific research, or statistics.
- Rights related to automatic decision making and profiling: You may challenge automated decisions or obtain more information.
- Right to data portability: You have the right to transfer your Personal Information between electronic systems.

Kinaxis’ response to a data request and/or security breach
We will respond to data requests within 30 days. In some cases, we may limit or deny requests if permitted by law, if it infringes on others' privacy, if the request is excessive, or if identity cannot be verified.
If the request requires processing beyond 30 days, we will inform the requester within 30 days and may charge a reasonable administrative fee.
Kinaxis uses technical and physical safeguards to protect your Personal Information, including encryption. While we strive to prevent loss or misuse, no system is completely secure. In case of a data breach, we will notify affected individuals without undue delay and relevant regulatory bodies within 72 hours where required by law.
Changes to this Privacy Policy
Kinaxis may review and update this Privacy Policy periodically without prior notice. We will post notices of changes on our website and indicate the date of the latest update. For material changes that may adversely affect you, Kinaxis may provide a more direct form of notification.
